Six Figure Settlement for Passenger in a One-Car Accident

In August 2010, she was on vacation traveling in a 2001 Ford Explorer southbound on I-95 in the State of Maryland. When the driver of the car she was traveling in swerved to the left to avoid another vehicle in her lane, the driver’s actions caused the vehicle to careen off the road and roll over several times, ejecting two occupants, including our client. Three individuals were seriously injured and taken by ambulance to Washington Hospital Center.

One ejected passenger sustained massive injuries, including a zygomaticomaxillary complex fracture in her face. (The zygomaticomaxillary complex (ZMC) plays a key role in the structure, function, and aesthetic appearance of the facial skeleton.) Our client’s facial injuries required a total of four separate plates inserted in locations around her face, secured with titanium screws, to repair the damage.

Travelers Insurance insured the vehicle. Progressive Insurance insured the driver (who was not the vehicle owner).

Once hired, we immediately dispatched an investigator to the Maryland auto yard to inspect and photograph the Ford Explorer vehicle before it was seized by one of the insurance companies. A lawsuit was commenced, and after the exchange of documents, a settlement was reached in which both insurance companies paid out their entire policies over to our client.
