We Recently Resolved a Case for a Lovely Client Who Sustained Multiple Fractures and other Serious Injuries When a Truck Driver Clearing Snow from a Strip Mall Parking Lot Backed up His Truck and Struck Our Client Sending Her to Hospital.

The Incident
Martin + Colin, P.C. announced a settlement for our client who suffered multiple rib fractures, a punctured lung and other injuries due to the negligence of a snow plow driver. Our client had gone to a local strip mall to pick up takeout food. While crossing the parking lot as she returned to her car, the driver carelessly backed up into our client, striking her and knocking her to the ground. As a result, our client sustained several rib fractures, a severe right scapula fracture, a collapsed right lung, and a deep gash down her right leg. Immediately calling 911, our client was transported to a nearby hospital where she was admitted and remained for 10 days. After release from the hospital she required an additional two weeks at a rehabilitation facility.
The Lawsuit
Shocking yet unsurprising, the snow plow driver testified that he did not strike our client with the truck, rather our client simply slipped on ice behind his vehicle.
The Mechanism of Injury
The truck driver’s defense set in motion the legal team at Martin + Colin. Our mission was to establish and prove the mechanism of our client’s injuries. “Mechanism of Injury” describes the way in which the person sustained the injury; how the person was injured; or the process by which the injury occurred. In this case, we were able to establish that the location and type of fractures resembled blunt force trauma injuries rather than ‘slip and fall and strike the ground’ injuries. Thus, our careful analysis of the “Mechanism of Injury” pointed to the truck driver’s operation of his vehicle as the cause of her injuries.
The Satisfactory Resolution
After the logical testimony of our client left no doubt as to the cause of her severe injuries, and demonstrated the utter implausibility of the truck driver’s testimony, the legal team at Martin + Colin was able to conclude a settlement favorable to the client. Martin + Colin was able to obtain the full amount of two motor vehicle policies plus an additional contribution from the owner of the strip mall.
